By using Elementals, you agree to these terms. Please read them carefully.

Definitions

In these terms, the following definitions apply: 'Platform': the web application Elementals, accessible at elementals.nl. 'User': any natural person or legal entity that uses the Platform. 'Assessment': a personality test offered through the Platform. 'Subscription': an ongoing paid access to premium features. 'Theuws Consulting': Theuws Consulting, based in Bladel, registered at the Chamber of Commerce under number 71820132.

Applicability

These terms apply to all use of the Platform and all agreements entered into between Theuws Consulting and the User. By using the Platform, you agree to these terms. Theuws Consulting reserves the right to modify these terms; modified terms take effect 30 days after publication on the Platform.

Use of the Service

Elementals offers personality assessments based on the Big Five model, enriched with narrative elements from Norse mythology. The free tier gives you access to a full assessment with results. Paid subscriptions offer additional features such as detailed reports, tracking over time, and AI coaching. You are responsible for the proper use of your account.

Intellectual Property

All content, assessment questions, scoring algorithms, archetype descriptions, visual elements, and the underlying methodology are the property of Theuws Consulting. It is not permitted to copy, reproduce, or use Elementals content for commercial purposes without written permission.

Payments and withdrawal

Elementals offers both monthly subscriptions and one-time purchases. Personal prices include 21% VAT. Coach prices are displayed excluding VAT; the total amount including VAT is confirmed at checkout. Payments are processed through Mollie. Subscriptions are billed automatically on a monthly basis. You can cancel your subscription at any time; you will retain access until the end of the current billing period. Under EU consumer law, you have a 14-day cooling-off period after purchase for digital services, unless you have explicitly waived this right when starting the service.

Limitation of Liability

Elementals provides personality insights to support personal development. Our assessments are not a substitute for professional psychological advice, diagnosis, or treatment. Theuws Consulting is not liable for decisions you make based on your assessment results. The service is provided 'as is', without guarantee of uninterrupted availability.

Force Majeure

Theuws Consulting is not liable for failures in performance resulting from circumstances beyond its control, including but not limited to: hosting infrastructure failures, internet connectivity issues, power outages, or the unavailability of third-party services (including payment processors and AI services).

Confidentiality

Theuws Consulting treats all personal assessment data as confidential. Data is not shared with third parties, except when legally required. For coaches, Theuws Consulting acts as a processor in accordance with the GDPR. Anonymised and aggregated data may be used for scientific research and product improvement.

Termination

You can cancel your account at any time through your account settings. When cancelling a paid subscription, you retain access until the end of the current billing period. We reserve the right to terminate accounts that violate these terms or misuse the service.

Data processing

Elementals processes personal data in accordance with the General Data Protection Regulation (GDPR). For coaches and organizations, we act as a data processor for client data. A full overview of how we handle personal data can be found in our privacy policy.

Complaints

Complaints about the service must be submitted in writing within 14 days of discovery via [email protected]. Theuws Consulting aims to resolve complaints within 14 business days. If a complaint is not resolved satisfactorily, the User may submit a dispute to the European Online Dispute Resolution platform (ODR): https://ec.europa.eu/consumers/odr.

Applicable Law

These terms and all agreements are governed by Dutch law. Disputes shall be submitted to the competent court in the district of Oost-Brabant.
